Federal independent dispute resolution rule corrected, payment determination text restored and applied back to August 3
Aug 30, 2026 edition · GC-2026-0001 · Published 2026-08-30 · Version 3 · Effective
The August 28 federal IDR correction restores omitted payment-determination text and repairs cross-references. It applies from August 3, so dispute procedures based on the earlier publication need comparison with the restored language.

What happened
Treasury, Labor, HHS and OPM published a correcting amendment on August 28 to their June 4 Federal Independent Dispute Resolution Operations final rule. The correction repairs omissions and references in the parallel tax, labor and health-insurance regulations. It became effective August 28 and applies beginning August 3, the original rule’s effective date. The departments reproduce the payment-determination paragraph in full because the earlier text was incomplete, rather than treating the missing text as an issue only for future disputes.
The restored language makes a certified IDR entity’s determination binding unless fraud or intentional misrepresentation of material claim facts is involved, and preserves the specified limited grounds for judicial review under federal arbitration law. Other edits remove an inadvertently retained word and repair references between procedural provisions. The departments describe these changes as corrections to the policies already established through notice and comment, invoking good cause rather than opening another proposal. For organizations handling out-of-network payment disputes, the practical distinction is between unchanged policy intent and the corrected regulatory text that submissions and vendor procedures actually cite.

Why it matters
Hospitals and provider groups that run out of network payment disputes have been operating since August 3, 2026 against regulation text that did not say what the departments intended it to say. The restored payment determination and binding determination language is the operative text for disputes already in flight, so an internal procedure, a certified IDR entity submission template, or a vendor workflow built from the June 4 publication may cite paragraphs that no longer read the same way.
Recommended action
Pull the corrected sections of 45 CFR part 149 and compare them against the No Surprises Act dispute procedure, the offer and supporting information templates, and any vendor or outside counsel workflow. Confirm that submissions made on or after August 3, 2026 satisfy the restored text, note any that do not, and document the review and its date.
