AB-1794 Pharmacy: enteral nutrition supplements or replacements

AB 1794 proposed home delivery of defined therapeutic enteral nutrition with prescriber and pharmacy conditions.

What happened

AB 1794’s August 27 enrolled proposal would permit a pharmacist, manufacturer or wholesaler to participate in an arrangement to deliver qualifying enteral nutrition directly to a patient’s residence. It requires a valid order by a prescriber acting within scope and pharmacist activities consistent with the accepted standard of care. The defined products are medical food used to prevent serious disability or death in medically diagnosed conditions that prevent full use of regular food.

The provision is separate from existing dangerous-drug/device and dialysis distribution rules elsewhere in Section 4059. Those rules retain their own authorization, training, safety and record requirements. The proposed medical-food arrangement therefore would not authorize unrestricted delivery of every supplement, drug or device, and a product’s marketing label alone would not establish qualification. The bill remained a proposal during the edition’s coverage, requiring final legal authority before an organization changed a regulated delivery arrangement.

Why it matters

Pharmacies and nutrition suppliers need product and workflow scope checks rather than treating all home-delivered nutrition alike.
