AB-173 Health

AB 173’s September 18 enactment changes the Medi-Cal affiliation-risk framework, subject to federal implementation conditions.

What happened

Governor Newsom signed AB 173 on September 18, and Chapter 252 records approval and filing that day. The health budget act takes effect immediately, while its Medi-Cal enrollment section carries specific implementation conditions. WIC 14043.2 directs denial or termination when an applicant or provider discloses an affiliation within the previous five years with a person or entity that experienced a disclosable event and DHCS determines an undue risk of fraud, waste or abuse. Federal definitions and the factors in 42 CFR 455.107(f) govern the affiliation and risk analysis.

Full and timely disclosure does not prevent DHCS from taking action when the affiliation poses the required undue risk. At the same time, legally protected health care activity cannot be treated as fraud, waste or abuse merely because of the nature of that activity. Implementation requires all necessary federal approvals and available federal financial participation without jeopardizing that funding. The section also preserves information-disclosure obligations, consequences for missing or false information and proceedings under Section 14043.65. The chapter therefore ends the bill’s pending status without proving that every new enrollment procedure was operational during this edition’s coverage.
