What happened

CMS Transmittal 247 revises AppendixW guidance for Critical Access Hospital emergency-services readiness, with both effective and implementation dates of September 18. It addresses 42 CFR 485.618(e), whose underlying readiness standard was effective July 1, 2025, and follows the earlierQSO 26-07 memorandum. Protocols must match nationally recognized, evidence-based guidance for medical, surgical and obstetrical emergencies, complications and immediate post-delivery care, consistent with the facility’s services and complexity.

Survey procedures focus on three elements: required protocol content, implementation and use as intended, and adequate provisions for emergency needs. The guidance discusses medical-staff and governing-body approval, staff access and roles, supplies, equipment, medications and blood products, with record review, interviews and observation supporting evaluation. Failure of any of the three elements can establish noncompliance. Surveyors are told to avoid evaluating clinical judgment and focus on documentation and protocol alignment. CMS supplies no additional funding; the new transmittal date does not erase the earlier underlying readiness obligation.
