AB 1973 expands qualifying abortion procedure authority
Oct 4, 2026 edition · GC-2026-0070 · Published 2026-10-04 · Version 2 · Final
AB 1973 removes the prior first-trimester limitation from specified licensed abortion authority while preserving training and practice conditions. The final text requires NP and CNM written consultation or transfer procedures for procedural abortions beyond the first trimester and retains PA practice-agreement controls.
What happened
California enacted AB 1973 on September 27, amending Business and Professions Code sections 2253, 2725.4 and 3502.4. Section 2253’s exception to unauthorized medical-practice liability now addresses an abortion performed under a valid license or certificate that authorizes the procedure, removing the prior first-trimester medication-or-aspiration formulation. Nurse practitioners, certified nurse-midwives and physician assistants must still meet their applicable practice-act and training requirements. Procedural training must include didactic and clinical components; exclusively online or simulation-only programs without mandatory direct-patient clinical hours do not satisfy those clinical requirements. The enactment is the event reported here; the applicable commencement of these provisions must be confirmed separately.
NPs and CNMs must practice within their clinical and professional education and training and applicable standards of care. For procedural abortion beyond the first trimester, they must establish and follow written consultation, collaboration, referral and physician-transfer parameters for care beyond their training or experience through one of the specified policy or standardized-procedure routes. The section does not authorize NP or CNM surgery. A trained and competent PA may perform procedural abortion without the supervisor’s personal presence unless the practice agreement requires it, but remains subject to that agreement and professional scope. Expanded procedure authority therefore does not remove training, supervision or escalation conditions.

Why it matters
Privileging and service planning depend on the individual profession, demonstrated competency and required backup arrangements. Removing a gestational restriction from one statutory formulation is different from authorizing every licensed practitioner to perform every procedure independently.
Recommended action
Confirm the applicable commencement before treating the new provisions as current duties. Prepare the following for implementation at that commencement: Clinical leadership should review each proposed service against license scope, training validation and facility privileges. Prepare NP/CNM written consultation and transfer procedures for the specified services and reconcile PA practice agreements. Confirm direct-patient clinical training rather than relying solely on an online or simulated course.
