AB-2311 Health care districts: employment

AB 2311 creates a temporary physician-employment pathway for qualifying district-controlled hospitals, with eligibility limits, clinical-independence safeguards and public recruitment reports.

What happened

California chaptered AB 2311 on September 18, 2026, adding a limited exception to the corporate practice prohibition for a health care district, or a nonprofit with a health care district as its sole corporate member, that owns or controls a general acute care hospital. The pathway lasts until January 1, 2037. It applies only if the hospital received a Distressed Hospital Loan Program loan before January 1, 2025, or meets the specified greater-than-75-percent combined Medicare and Medi-Cal payer-mix test using January 1, 2025 data. For the payer-mix route, both the hospital and its health system, if any, must qualify. The enactment therefore does not authorize physician employment at every district hospital.

Use of the pathway requires an affirmative medical staff vote under its bylaws, protection of professional judgment, and positions that add to rather than supplant medical staff professional-service positions existing on January 1, 2026. The district or nonprofit must affirmatively offer a prospective employee the option to contract instead; existing professional-services contracts may be amended by mutual agreement. Beginning January 1, 2028, an entity using the pathway must publish a report by July 1 each year covering recruitment and retention in the prior year and cumulative totals since January 1, 2027, separating employed and contracted positions. Under the ordinary constitutional rule the nonurgency law takes effect January 1, 2027; the temporary authorization and subsequent reporting schedule should be planned separately.

Why it matters

The exception can support recruitment at qualifying hospitals, but eligibility, medical staff concurrence and protection of existing positions are prerequisites rather than optional safeguards.
