AB 2341 changes local-agency emergency translation calculations immediately

AB 2341 immediately changes how local agencies determine emergency-translation languages. Once the jurisdiction meets the five-percent limited-English threshold, each language is measured against the population speaking English less than very well, with periodic reassessment and quality protections.

What happened

California enacted AB 2341 as Chapter 170 on August 31 with an express urgency clause making it effective immediately. Amended Government Code section 7299.7 first asks whether at least five percent of the jurisdiction’s population speaks English less than very well, using American Community Survey data or an equally reliable source. Once that threshold is met, emergency information must be provided in English and each language spoken by at least five percent of the limited-English population. The denominator for identifying the languages is therefore the population speaking English less than very well, rather than everyone in the jurisdiction.

Local agencies must reassess the data every five years and make translated emergency information as comprehensive, actionable and timely as English information. They should endeavor to use culturally competent community members and fluent native speakers when feasible. The statutory local-agency definition covers cities, counties, a city and county, and their departments; it does not assign the same duty to every private hospital. A separate state office sampling survey starts January 1, 2027 and repeats every three years. The law preserves other emergency-service duties and permits more expansive local standards.

Why it matters

A narrower language-selection denominator can materially change emergency templates and translation resources. Public health, EMS and county-operated services should identify their agency scope and communications without treating the later state survey date as a delay in the immediately effective translation rule.
