AB 175 recasts regional-center planning around community resource development plans, with the new framework operative October 1. It combines community transition assessments, shared specialty resources, advocate notice, and public reporting, while preserving existing or pending plan-related agreements and funding documents.
What happened
The September 18 chaptered AB 175 makes its replacement community resource development framework in Welfare and Institutions Code section 4418.25 operative October 1. DDS must establish annual plan policies and procedures in coordination with regional centers, covering both transitions from restrictive settings and the needs of individuals already living in the community. Plans provide dedicated funding for comprehensive assessments and identified transition costs. Regional centers must tell DDS about specialty resources developed with plan funds and make those resources available to other regional centers.
The assessment must include the individual and regional center, with family or authorized representatives where appropriate, and identify community services, supports, and residential options. Regional centers must give relevant clients' rights advocates at least 30 days' notice of an individual program plan meeting that will discuss the assessment or an update; an advocate may participate unless the individual objects. DDS must update the Legislature by April 1 annually and publish the update after applying privacy-protecting deidentification guidelines. That is a department reporting obligation. The new section expressly preserves plan-related agreements, promissory notes, deeds of trust, approvals, and related documents in effect or pending as of October 1.
