AB 1864 requires qualifying nucleic acid synthesis screening
Oct 11, 2026 edition · GC-2026-0229 · Published 2026-10-11 · Version 3 · Final
AB 1864 requires covered synthesis-equipment manufacturers and nucleic-acid providers to follow and publicly attest to a fixed September 2024 screening framework. It distinguishes mandatory from recommended framework language and defers specified later-phase provisions until October 13, 2027.
What happened
California enacted AB 1864 on September 30 as Chapter 852. Covered manufacturers may not produce benchtop nucleic-acid synthesis equipment in California or sell or deliver it to a California customer without adhering to the referenced framework and publicly posting the required attestation. Providers face parallel conditions for synthetic nucleic acids subject to screening. The incorporated framework is solely the September 2024 version; federal revisions and successors do not automatically change it without legislative amendment. Framework provisions using should become requirements, while encouraged provisions remain recommendations.
Provisions that the framework states take effect only on or after October 13, 2026 have no effect under this chapter before October 13, 2027. That express deferral is separate from ordinary effectiveness of the California statute. The chapter does not regulate a customer's activities when the customer is neither a covered provider nor manufacturer, including the enumerated research, therapeutic, and manufacturing uses; dual-role entities remain covered for their provider or manufacturer activities. Severity-dependent civil penalties can reach $5,000 per continuing day and are recoverable only in an Attorney General civil action. The act does not itself establish a particular supplier's compliance.
