AB 1973 expands qualifying abortion procedure authority

AB 1973 removes the prior first-trimester limitation from specified California abortion-authority provisions. The September 27 law retains profession-specific training and scope conditions, and adds written consultation and transfer procedures for nurse practitioners and certified nurse-midwives performing procedural abortions beyond the first trimester.

What happened

California enacted AB 1973 on September 27 as Chapter 487. The amended authorization in Business and Professions Code section 2253 no longer limits the identified exception to medication or aspiration abortion in the first trimester; a practitioner must still hold a valid license or certificate authorizing the procedure. Nurse practitioners and certified nurse-midwives performing procedural abortions must achieve clinical competency through the specified training routes, which include clinical and didactic components. Their care must remain consistent with applicable standards and their clinical and professional education and training.

For a procedural abortion beyond the first trimester, a nurse practitioner or certified nurse-midwife must establish, maintain, and follow written parameters for consultation, collaboration, referral, and transfer to a physician when needed care exceeds their education, training, and experience. The law specifies alternative policy and standardized-procedure routes for meeting that requirement. Physician assistants separately need supervising-physician authority, validated competency, and compliance with their practice agreement; the agreement may require the physician's personal presence. Exclusively online or simulation-based training without mandatory direct patient-care clinical hours does not satisfy the stated clinical training requirements.
