AB 2030 restricts sales, promotional giveaways, and delivery of defined weight-loss pills and weight-loss or muscle-building supplements to California minors. Product representation controls coverage, with prescribed-use and adult exceptions and distinct retail and delivery-verification provisions.
What happened
California enacted AB 2030 on September 28 as Chapter 720. The act prohibits selling, offering, or promotional giveaways of covered nonprescription diet pills and dietary supplements to people in California under 18, with a prescription exception. Coverage turns on labeling, marketing, or other representation for weight loss or muscle building, with specified ingredients, claims, seller displays, and categorization among factors courts may consider. Pharmacies and online vendors are included in the retail definition; the act does not classify every supplement or every clinical prescription as prohibited.
Retail identification checking and optional access controls accompany the restriction. Delivery sellers must use the specified independent database-based identity and age verification, adult-signature delivery with government photo identification, or both; the statute limits seller possession, control, or alteration of the verification database. Attorney General, county-counsel, or city-attorney enforcement can seek injunctions and up to $500 per violation, with prevailing-plaintiff fees and cumulative remedies. The section excludes people 18 or older and qualifying minors with a prescription. These scope and verification distinctions matter before treating an ordinary age confirmation or unrelated nutrition product as meeting the statutory rule.
