AB 2321 strengthens workplace safety investigation controls

AB 2321 expands Cal/OSHA criminal-investigation, notification, and referral controls for serious incidents and creates a willful-inspection-interference offense. The statutory evidence and willfulness conditions remain material; an incident notification or willful citation is not itself a criminal conviction.

What happened

California enacted AB 2321 on September 30 as Chapter 936. Willfully resisting or interfering with the specified Cal/OSHA inspection duties or related court orders becomes a misdemeanor, while the section retains reasonable inspection limits, credentials, warrant procedures, and evidence-preservation authority. The Bureau of Investigations must investigate serious-injury, illness, or exposure accidents with willful citations as well as its other defined categories. Serious-violation reports involving one to four affected employees require review and investigation when criminal violations may have occurred. Required cases proceed to prosecutors unless legally sufficient criminal evidence is lacking.

The act expands immediate agency notifications for serious exposures and directs routine transmission, written case-review procedures, documented nonreferral reasons, and legislative reporting. Specified confidential material may be shared with law enforcement or prosecutors for an investigation or prosecution, with trade-secret protections retained. Section 6425 extends the existing public offense to willful safety violations causing serious injury, illness, or exposure, alongside death and permanent or prolonged impairment. Those causation and willfulness elements distinguish criminal exposure from every workplace injury. The notification duties identify responding agencies and Cal/OSHA responsibilities; they should not be recast as a newly uniform provider filing clock.
