CMS makes revised Critical Access Hospital emergency-services readiness guidance effective immediately

CMS made revised Critical Access Hospital emergency-readiness survey guidance effective September 18. Transmittal 247 emphasizes evidence-based protocols and adequate provisions for medical, surgical, obstetrical, and neonatal emergencies, and explains how surveyors assess written protocols, their use, and available resources.

What happened

CMS issued State Operations Manual Transmittal 247 on September 18 with the same effective and implementation dates. The Appendix W revision follows the cited March 2026 survey memorandum and aligns interpretive guidance with emergency-services readiness requirements implemented July 1, 2025. Tag C-0896 addresses nationally recognized, evidence-based protocols for emergency patients, including obstetrical complications and immediate post-delivery care. The transmittal dates the guidance revision; it does not establish a new October grace period for the underlying condition of participation.

The guidance links protocols to the hospital's patient population and the scope and complexity of its services, with medical-staff and governing-body approval and access for responding staff. Adequate provisions include the equipment, supplies, medications, blood products, and personnel needed for emergency care. Surveyors examine whether written protocols contain required elements, whether staff use them, and whether the facility has the provisions to meet patient needs. The procedures include record review, staff interviews or demonstrations, equipment checks, and escalation or transfer when an emergency exceeds the CAH's capabilities; they direct surveyors to focus on documentation and protocol alignment rather than evaluate clinical judgment.

Why it matters

Critical Access Hospitals can be surveyed against the revised interpretive guidance now. Emergency protocols, staffing, transfer readiness, and obstetrical response evidence must align with the current Conditions of Participation.
