DEA removes exemptions for inactive butalbital products

DEA's October 9 determination removes exemption status for listed inactive butalbital product NDCs from November 9. It expressly leaves exempt products with active NDCs unaffected and describes a table cleanup of products no longer marketed, rather than a universal change for every butalbital formulation.

What happened

DEA's final determination published October 9 revokes exempt-prescription status for listed butalbital products whose NDCs are inactive because they are unavailable or the original applicant no longer exists. The determination takes effect November 9, 2026 and removes the identified entries from the exemption table. DEA expressly says the action does not affect exempt products with active NDCs. Product identity and table status therefore matter before translating this action into dispensing or inventory changes.

The source identifies butalbital as a Schedule III barbiturate and explains the historical exemption for certain combinations intended to reduce abuse potential. Of 189 listed products, DEA identified 160 inactive NDCs and confirmed with FDA that they were no longer marketed before proposing removal. It describes this action as having no practical effect on those unavailable products. That rationale should remain distinct from a conclusion that all currently marketed combinations lose their exemption, or that a new application or product inherits exemption solely because it contains the same ingredients.

Why it matters

Active exempt NDCs are unaffected. DEA describes the removed products as no longer marketed; this is not a blanket scheduling change for all butalbital combination products.
