FDA expands limited toxicology test system premarket notification exemptions

FDA's October 6 order expands certain clinical toxicology 510(k) exemptions to qualifying federal drug-testing uses. The devices remain Class II, with employment/insurance labeling and general exemption limitations; the order does not exempt ordinary clinical diagnostic uses wholesale.

What happened

FDA's final order effective October 6 removes the federal-drug-testing exception from the existing partial premarket-notification exemptions for 14 specified Class II toxicology test-system categories. The change follows the May proposal and public comments and extends the exemption to qualifying federal testing programs. It concerns whether a 510(k) submission is needed for the defined device and intended use, rather than reclassifying these systems out of Class II or declaring every drug-testing product exempt.

The amended classifications retain employment- or insurance-testing-only use and the corresponding labeling statement, together with the general limitations in 21 CFR 862.9. A device exceeding those limits still needs premarket notification. FDA explains that other applicable requirements, including federal testing-program standards where applicable, remain distinct from the 510(k) exemption. Thus the exemption should be assessed against the particular classification, intended use, technology, and labeling, without assuming permission for broader clinical testing or treating exemption as product-specific FDA clearance.

Why it matters

The exemption remains limited to specified product codes and employment or insurance testing, with labeling and scientific-technology limits. It does not exempt all clinical toxicology diagnostics or remove other device controls.
