FDA consults on food-traceability flexibility and small retail operations
Oct 11, 2026 edition · GC-2026-0308 · Published 2026-10-11 · Version 3 · Draft
FDA opens two food-traceability consultations: draft enforcement discretion for certain retail/restaurant operations and a November 6 meeting on lot-level tracking. The notices set different registration and comment dates and do not finalize the proposed flexibility.
What happened
FDA's October 9 draft-guidance notice addresses retail food establishments and restaurants above the existing small-operation exemption. That exemption uses food sold or provided averaging no more than $250,000 annually over the prior three years, on a rolling basis and adjusted for inflation from 2020. The draft instead describes intended enforcement discretion for operations above $250,000 through $1 million on the same basis. FDA states that the guidance creates no rights and is nonbinding; November 23 comments are requested before work begins on the final version.
A separate notice announces a November 6 virtual public meeting from noon to 3:30 p.m. Eastern on challenges and possible solutions for lot-level traceability. The discussion concerns possible flexibilities and implementation experience, rather than adoption of every suggestion summarized in the notice. Speakers must register by October 26, general registration closes November 5, and written meeting comments are due December 6. Same-day registration is unavailable, and oral presentations cannot use slides. Those meeting dates are distinct from the draft-guidance comment deadline and from the underlying rule's enforcement timing.

Why it matters
The draft discusses discretion for retail/restaurant operations with inflation-adjusted three-year average food sales above $250,000 through $1 million. It creates no binding rights or blanket hospital exception. FDA separately describes Congress's direction against enforcement before July 20, 2028.
Recommended action
Food-service and supply-chain owners should assess entity-specific applicability and traceability gaps before considering comments. Keep the November 23 guidance docket and December 6 meeting docket separate; the draft is not a binding hospital exception.
