California requires county procedures for involuntary-commitment designations

SB 16 makes county procedures for designating and training involuntary-commitment professionals mandatory. The September 18 law requires emergency physicians to be an eligible discipline while preserving county qualification, training, application, monitoring, and approval processes; it does not automatically designate every emergency physician.

What happened

California chaptered SB 16 on September 18 as Chapter 314. Amended Welfare and Institutions Code section 5121 requires each county behavioral health director to establish and implement procedures for professionals designated to perform section 5150 functions. Those procedures must address eligible licenses, disciplines and clinical experience; initial and ongoing training and testing; application and approval timeframes and renewal; and monitoring for compliance with law and county procedures. A complaint-responsive passive monitoring process can satisfy the identified monitoring requirement.

An emergency physician must be included among eligible practice disciplines, but the law expressly preserves the training, application, approval, and revocation process that applies to other eligible professionals. The definition covers a physician providing screening and treatment in a licensed general acute care hospital's emergency department. If a designation is denied or revoked, the county director must give the requester and affected person written reasons. The section preserves county criteria consistent with its terms and states that designated mobile-crisis team members and professional persons may not be barred from transporting a person taken into custody under section 5150.

Why it matters

Hospitals and behavioral health programs depend on valid county designations and documented training. Emergency departments may gain eligible designees but also need to align with county renewal and monitoring rules.
