Transparency in Coverage final rule sets phased machine readable file changes
Oct 11, 2026 edition · GC-2026-0255 · Published 2026-10-11 · Version 3 · Final
The October 6 Transparency in Coverage final rule phases in rate-file changes from March 6, 2027 and contextual-file and website requirements from September 6. Its explicit utilization-file posting date is July 1, 2028. Those duties, recurring posting cadences, and the December 7, 2026 legal effective date serve different purposes.

What happened
Treasury, Labor, and HHS published the final Transparency in Coverage rule October 6, effective December 7, 2026. For covered non-grandfathered plans and issuers, the public-disclosure amendments generally apply March 6, 2027, including network-level in-network rates, market-level out-of-network reporting, exclusions for unlikely provider-service combinations, and attestations. The allowed-amount threshold becomes 11 claims, with the specified six-month data window. Rate and allowed-amount files move to quarterly posting beginning April 1, 2027, the first calendar quarter after applicability, while prescription-drug files remain monthly. Prior-rule requirements continue until the applicable transition dates.
The contextual-file and website-footer provisions apply September 6, 2027, but their posting rules remain distinct: taxonomy and text files first post October 1, 2027 under the calendar-quarter rule, while the utilization file first posts July 1, 2028 and annually thereafter. The text file provides locations and contact information, with changes updated within seven calendar days, and footer links help users find disclosures. Separately, consumer cost-sharing information must be available by telephone on request, with the amended consumer-tool provisions applying to plan or policy years beginning on or after January 1, 2027 and the identified No Surprises Act treatment also reaching grandfathered coverage. The September applicability date therefore should not replace the utilization file's express later first-posting date.

Why it matters
Non-grandfathered group plans and issuers must coordinate network aggregation, narrower rate reporting, quarterly in-network and allowed-amount updates, and minimum-claim thresholds. Prescription drug files remain monthly. The separate phone-estimate provision also reaches grandfathered coverage.
Recommended action
Inventory affected plan products and vendors, preserve the three distinct implementation phases, and test accurate consumer estimates against current data. Do not treat every new file as due in September 2027.
