What happened

DOJ announced on September 30 that Independence Blue Cross agreed to a $22.5 million False Claims Act settlement concerning Medicare Advantage risk-adjustment payments. The government alleged that the Pennsylvania insurer submitted inaccurate diagnosis data, failed to withdraw unsupported diagnoses and repay the resulting overpayments, and falsely certified the data as accurate. Medicare Advantage organizations receive monthly payments adjusted for beneficiaries’ expected healthcare costs. Diagnoses matter because they help determine those adjustments; the case therefore concerns payment data and later correction obligations, rather than simply whether a service occurred.

The allegations focus on payment years 2017 through 2021. According to DOJ, nurse chart reviewers identified supported conditions and IBX used those results to submit additional diagnoses, but did not delete earlier codes that the same reviews failed to substantiate. The government characterized that asymmetric use of review results as retaining payments to which the plan was not entitled. The settlement also resolves a former employee’s whistleblower lawsuit and provides a $3.825 million relator share. The release expressly states that the resolved claims remain allegations and that liability has not been determined.
