Abbott agrees to pay about $385 million over alleged WIC and Medicaid product-quality misrepresentations

Abbott’s roughly $385 million settlement resolves disputed government-payment claims tied to formula manufacturing and quality representations. The agreement separates federal, state Medicaid and Massachusetts WIC amounts, conditions releases on payment, and reserves several other categories of claims.

What happened

The Abbott settlement concerns allegations about powdered infant formula and nutritional products manufactured at its Sturgis, Michigan, and Casa Grande, Arizona, facilities. The agreement defines the covered period as January 1, 2018, through December 31, 2022. Government parties contend that Abbott failed to meet applicable manufacturing requirements and made inaccurate representations connected with purchases funded through WIC and Medicaid. Abbott denies the allegations. The agreement resolves specified civil claims arising from that covered conduct; it is not an admission that the disputed allegations are true.

The required settlement amount is $384,999,040.12 plus interest, divided among the federal government, participating state Medicaid programs and Massachusetts WIC. The federal release is conditioned on receipt of the federal payment, so an executed agreement alone does not establish completed payment or collection. Reserved claims include criminal liability, specified administrative remedies, other conduct and personal-injury or property-damage claims. The agreement also treats specified investigation, defense, corrective-action and settlement costs as unallowable government-program costs and requires separate accounting. These limits matter when evaluating what the resolution settles and how related costs may enter government contracts or Medicaid cost reporting; later payment performance was not independently established for this edition.

Why it matters

The settlement connects product-quality compliance, government-program eligibility representations, and False Claims Act exposure. Medicaid and WIC suppliers need evidence that regulatory and contractual quality claims remain accurate throughout production.

Operational lessons

  • Product-quality deviations can create payment-integrity exposure.
  • Program eligibility representations need continuing support.
  • Unallowable settlement costs must be separated from government-program claims and cost reporting.
