Queens pharmacy indictment alleges HIV drug buybacks and unsafe supply
Oct 11, 2026 edition · GC-2026-0265 · Published 2026-10-11 · Version 4 · Pending litigation
New York charged Miguel Baron and two pharmacies over alleged HIV-drug kickbacks, buybacks and repeat billing. More than $31 million in alleged reimbursements is distinct from a separate civil forfeiture action seeking over $95 million. Neither the indictment nor the requested damages establish a conviction or recovery.

What happened
New York’s October 7 release reports the arrest and indictment of Miguel Baron, Guardiola Pharmacy and Baron Specialty Pharmacy. The Attorney General alleges that, from January 2023 through April 29, 2026, recipients were offered cash incentives, often $150–$250, to fill prescriptions and sometimes sell medication back. Repurchased HIV medications allegedly returned to inventory for dispensing and repeated reimbursement, while other drugs came from unlicensed sources. The state alleges more than $31 million in Medicaid and AIDS Drug Assistance Program reimbursements.
The allegations raise two connected concerns: patients may miss prescribed treatment after selling medication back, and other patients may receive products without assurance of proper storage or lawful sourcing. The criminal case includes healthcare-fraud, larceny, kickback and money-laundering charges. A separate civil forfeiture action seeks more than $95 million and concerns assets allegedly bought with proceeds; that request is not an additional amount already recovered. The defendants are presumed innocent. Pharmacy oversight should distinguish the pending allegations while examining inventory provenance, patient incentives and repeat-billing patterns together.
