AB-350 Health care coverage: fluoride treatments

Pending AB 350 addresses medically necessary fluoride varnish across medical and dental billing and proposes Medi-Cal guidance for members under twenty-one, with training and federal conditions.

What happened

AB 350 would require specified contracts and policies issued, amended or renewed from January 1, 2027 that cover pediatric fluoride varnish to cover medically necessary applications without cost sharing whether billed as a medical or dental benefit. Specialized coverage and Medicare supplements are excluded from that commercial provision, which also has a state-defrayal appropriation condition. Medi-Cal managed care is addressed separately through the proposed Medi-Cal benefit provisions. The bill remains pending at this edition’s cutoff; it does not establish a newly enacted universal cost-sharing prohibition.

For Medi-Cal members under twenty-one, the proposal directs DHCS to issue billing guidance and necessary EPSDT-consistent coverage updates by July 1, 2027, subject to utilization controls and federal approval and funding conditions. It would allow fluoride varnish without place-of-service restrictions when provided by an enrolled licensed medical or dental provider, or a trained qualified health/public-health professional working within scope and under the specified supervision. The supervising enrolled provider bills, verifies training and retains documentation. Training, supervision, enrollment and funding conditions therefore matter alongside the age and site-of-service changes.
