AB 1629 changes noncontracted dental assignment of benefits
Oct 4, 2026 edition · GC-2026-0243 · Published 2026-10-04 · Version 2 · Final
AB 1629 establishes a conditional direct-payment pathway for assigned out-of-network dental benefits and related patient disclosures.
What happened
California approved and filed AB 1629 on September 27. Its new assignment provisions require direct payment to a noncontracting dental provider, including a registered dental hygienist in alternative practice, for covered services when an assignment is submitted under the statute. The pathway applies to contracts or policies covering out-of-network dental services; it does not create that benefit where absent. The plan provision excludes Medi-Cal managed care, including dental managed care. Before obtaining an assignment, the provider must explain noncontracted status, potentially lower patient costs in-network, estimated treatment and patient costs, possible lack of benefits, the right to confirm coverage, and the optional, prospectively revocable assignment.
The provider must retain signed, dated consent, although it need not be submitted to the carrier if the provider maintains the record. Before carrier payment, collection is limited to an estimate of the patient’s cost sharing or a deposit approximating it. Related professional-conduct provisions support those disclosures, consent and collection limits. Assignment transfers reimbursement rights for rendered services; it does not turn the provider into a network participant or guarantee coverage for treatment outside the benefit. As of October 4, this enacted text supports preparation of forms and payment handling, with applicable commencement confirmed before treating the new pathway as operative.
