AB 350 expands fluoride treatment coverage and guidance
Oct 4, 2026 edition · GC-2026-0057 · Published 2026-10-04 · Version 2 · Final
AB 350 addresses fluoride varnish cost sharing for qualifying 2027 commercial coverage and directs broader Medi-Cal billing guidance.
What happened
California approved AB 350 on September 27. For commercial contracts or policies issued, amended or renewed on or after January 1, 2027 that already cover fluoride varnish as a pediatric oral-care benefit, the enacted text requires medically necessary application without deductible, coinsurance, copayment or other cost sharing, whether billed as a medical or dental benefit. Specialized coverage and Medicare supplement coverage are excluded. The commercial plan section also excludes Medi-Cal managed care contracts. If the requirement creates a state obligation to defray costs, that requirement ceases to apply absent the specified appropriation; it does not make every product an unconditional new fluoride benefit.
The Medi-Cal provisions cover fluoride application or other department-defined fluoride treatment and other prophylaxis for children under 21. DHCS must issue billing guidance and necessary policy updates by July 1, 2027 consistent with EPSDT and subject to utilization management. The policy must allow varnish without place-of-service restrictions when a Medi-Cal enrolled, licensed medical or dental provider renders it, or when an eligible trained professional acts within scope under that provider’s supervision. Community health workers are included; additional nonlicensed practitioners depend on DHCS designation. The supervising provider bills, verifies training and retains documentation for review or audit. Implementation depends on necessary federal approvals and available federal participation, so the commercial contract date does not itself establish that Medi-Cal billing changes are ready.

Why it matters
Benefit configuration and pediatric access depend on different commercial and Medi-Cal conditions, provider qualifications and implementation milestones.
