What happened

DHCS’s September 25 draft Behavioral Health Information Notice clarifies proposed guidance on managed care plans’ responsibility for emergency services, including psychiatric emergencies, and post-stabilization care. The notice index requests feedback by October 12. The draft cites existing No Wrong Door guidance, AB 1316 and the managed care contract and behavioral health memoranda of understanding; it is presented for comment rather than a newly final BHIN as of October 4. Its discussion includes emergency-room professional services and facility charges.

The draft excludes specialty mental health services provided after admission for inpatient psychiatric care from the described managed care payment responsibility. It addresses emergency screening and care within the facility’s capability and says necessary psychiatric emergency care is covered regardless of voluntary status or an LPS involuntary detention. For people not enrolled in a managed care plan, it identifies fee-for-service as payer for emergency services with the same inpatient specialty-service boundary. It also describes behavioral health plan monitoring and documentation expectations. These distinctions give hospitals, plans and counties concrete responsibility and handoff questions to test in comments without treating the draft as eliminating every existing payer distinction.
