OIG flags organ acquisition reimbursement and documentation risks

OIG estimated $380 million for organ-acquisition costs outside Medicare-covered transplants and separately recommended recovering $154,210 for undocumented organ counts.

What happened

OIG's organ-acquisition audit, issued September 1 and posted September 3, 2026, reviewed costs reported for 2017–2022. Of 180 sampled organs reported as Medicare usable,43 were not used in Medicare-covered transplants and 12 were never transplanted. Medicare reimbursed $2.8 million for those 55 organs. OIG estimated about $380 million across the six-year period and identified a conflict between CMS guidance and the statutory limit on reimbursement for organs used in Medicare-covered transplants. The estimate does not assign an organization-specific liability or direct blanket recovery of $380 million.

The guidance assumed that organs removed and furnished to an organ-procurement organization or another transplant center would be used for a Medicare transplant, which did not always occur. Separately, two centers lacked documentation for five reported organs, producing $154,210 in unallowable reimbursement. OIG recommended MAC recovery of that amount and revision of the organ-counting guidance to align with the statute. CMS concurred with recovery, but did not specifically concur or nonconcur with the guidance recommendation. Documentation recovery and the broader policy conflict are therefore distinct findings requiring different follow-up.

Why it matters

Organ disposition and supporting records need to reconcile to cost-report counts, while guidance conflicts require legal and MAC review rather than an assumed blanket recoupment.
