SB 1049 gives qualifying claim corrections a minimum filing period
Oct 4, 2026 edition · GC-2026-0242 · Published 2026-10-04 · Version 2 · Final
SB 1049 provides at least 90 calendar days for qualifying corrected claims after the carrier’s most recent action.
What happened
California approved and filed SB 1049 on September 30. The enacted text adds parallel plan and insurer provisions for a denial of a claim or part of one, or an overpayment notice, based wholly or partly on a defect that can be remedied through a corrected claim. In that situation, the claimant receives no less than 90 calendar days from the carrier’s most recent action to submit the correction. The trigger is the qualifying carrier action and remediable defect, rather than every original claim, general appeal or unrelated late filing.
A correction submitted in accordance with that provision may not be denied because it missed a different otherwise-applicable claim-filing deadline. A dispute concerning that corrected claim must remain eligible for the carrier’s fast, fair and cost-effective dispute-resolution mechanism. The law authorizes departmental guidance and regulations, including consistent DHCS guidance for the plan provision. It protects the correction window without guaranteeing payment where the underlying coverage or other claim requirements remain unsatisfied. As of October 4, this is enacted text for preparation; teams should confirm applicable commencement and instructions before treating the newly added provisions as already operative.

Why it matters
Correction queues need the precise defect and carrier-action dates so qualifying claims receive the protected submission period without confusing it with every other filing or dispute deadline.
Recommended action
Prepare to capture denial and overpayment notices, identify remediable defects and preserve corrected-claim submission evidence. Confirm commencement and update filing edits and dispute routes for qualifying corrections.
