AB-1575 Lanterman Developmental Disabilities Services Act

AB 1575 proposed changing Lanterman Act terminology to “person eligible for regional center services.”

What happened

AB 1575’s retained proposal would replace “consumer” with “person eligible for regional center services” across the Lanterman Developmental Disabilities Services Act, make related terminology updates and remove gendered language. The terminology appears in a broad framework of regional-center services, individual planning and communications. During September 13–19, the measure remained proposed; the replacement language did not itself establish a new eligibility determination for a particular person.

The retained Section 4512 continues to define developmental disability by onset before 18, an indefinite duration and substantial disability, including the listed diagnoses and related qualifying conditions. It separately describes provisional eligibility for some children under five and reassessment before age five. Necessary services and supports are determined through the individual program plan using the person’s needs and preferences, available options, effectiveness and cost-effectiveness. Updating forms or labels must therefore preserve individual eligibility and planning distinctions rather than treating new terminology as a substitute for those decisions.
