AB-2311 Health care districts: employment

AB 2311 permits narrowly qualified health care districts to employ physicians with medical-staff and independence safeguards.

What happened

Chapter 299, signed September 18, adds a physician-employment exception for a health care district or specified district-controlled nonprofit that owns or controls a general acute care hospital. Qualification requires either a Distressed Hospital Loan awarded before January 1, 2025 or a combined Medicare/Medi-Cal payor mix greater than 75 percent under the specified January 2025 data. For the payor-mix route, both the hospital and its health system, if any, must meet the threshold. Medical staff must affirmatively concur under their bylaws, and the employer cannot direct professional judgment.

The employed positions must add to rather than supplant medical-staff positions existing January 1, 2026, although mutually agreed contract negotiations or amendments remain permitted. A prospective employee must also receive an affirmative option to contract instead. The employment authority runs until January 1, 2037; a separate section transition date should not be mistaken for that authorization period. Beginning January 2028, covered employers must post annual recruitment and retention reports by July 1, separating employment and contracted positions. Ordinary commencement is January 1, 2027, so qualification and staffing plans require review before using the exception.

Why it matters

The law provides a limited employment route, not a general waiver of California’s restrictions on corporate medical practice.
