AB 2341 changes local-agency emergency translation calculations immediately

AB 2341 immediately changes the language calculation for local-agency emergency translations.

What happened

AB 2341 became Chapter 170 on August 31 as an urgency statute effective immediately. GovernmentCode 7299.7 first asks whether at least 5 percent of everyone in a local jurisdiction speaks English less than very well. If that threshold is met, the local agency must provide emergency information in English and every language spoken by at least 5 percent of the jurisdiction’s population that speaks English less than very well. The second percentage therefore uses the limited-English population as its denominator, not the entire local population.

Agencies must use American Community Survey data or an equally reliable source and reassess language coverage every five years. Translated information must be as comprehensive, actionable and timely as English information, with culturally competent community assistance encouraged where feasible. The local-agency definition covers cities, counties, cities and counties, and their departments, including relevant emergency services. Starting January 1, 2027, the state Office of Land Use and Climate Innovation must survey a sample every three years. That later state oversight date does not defer the urgency law’s local translation duties or extend them to every private health care organization.

Why it matters

A jurisdiction can miss required languages if it applies the second 5 percent test to the wrong population. Local public-health and EMS operations should confirm their agency scope.
