OCR clarifies civil-rights protections against antisemitic discrimination

OCR’s September 3 letter explains protected-status discrimination in HHS-funded health care and training.

What happened

OCR’s September 3 letter explains how Title VI and Section 1557 apply to discrimination rooted in antisemitism in HHS-funded programs. It addresses actual or perceived Jewish ancestry or ethnic characteristics, Israeli national origin and other protected grounds, including patient care, clinical education, research and related covered operations. Recipients cannot accomplish through contractors or affiliations what the law prohibits directly. OCR distinguishes protected-status discrimination from individualized clinical, safety or operational judgments applied without discrimination.

The letter separately explains religious nondiscrimination in applicable programs and Medicare/Medicaid visitation protections, including reasonable clinical restrictions. It addresses harassment under the legal theory and facts involved, preserves First Amendment rights, and prohibits retaliation for protected complaints or participation. Its employment discussion recognizes limited Title VI jurisdiction rather than asserting general OCR authority over every employment dispute. Suggested measures include accessible reporting, responsible-staff training, consistent responses, restored access and follow-up; the letter creates no new universal implementation date.
