What happened

On September 25, California’s Attorney General reaffirmed enforcement of disability-integration and access protections. The official release reports that a federal court entered a September 23 order in Texas v.Kennedy vacating integration references in HHS’s Section 504 regulations and closing that case after a proposed resolution. This article reports the California enforcement announcement and its account of the order; the order itself is not retained or independently interpreted here. The announcement distinguishes the reported regulatory action from the ADA, Section 504 and longstanding integration precedent.

The Attorney General states that unnecessary segregation and isolation remain unlawful in California and points to community-based services and the rights of people with disabilities. The release also describes an August emergency-access guidance letter and a separate ongoing Eaton Fire response investigation, without establishing a finding in that investigation. Providers should not infer that the reported federal regulatory change eliminates every integration, access or nondiscrimination obligation. A policy change based on the litigation requires counsel’s review of the actual order and the applicable federal and California duties.

Why it matters

An agency’s litigation summary and state enforcement position do not establish the full operative scope of a court order or cancel other disability duties.
