OCR clarifies civil-rights protections against antisemitic discrimination
Sep 27, 2026 edition · GC-2026-0038 · Published 2026-09-27 · Version 2 · Announced
OCR’s September 3 letter describes protected-ground discrimination, harassment and retaliation in funded care and training, with jurisdiction and speech safeguards.
What happened
OCR’s September 3 letter explains how Title VI and Section 1557 apply to antisemitic conduct in covered HHS-funded programs when the facts show discrimination based on actual or perceived Jewish ancestry or ethnic characteristics, Israeli national origin or another protected ground. Examples reach care access and administration, training, research and contractual arrangements. The letter preserves individualized clinical, safety and operational judgments applied without discrimination and states that use of antisemitism-related evidence must not infringe federal or First Amendment rights.
The letter distinguishes harassment theories and the recipient’s own conduct or response, rather than applying one private-damages test universally to administrative enforcement. It also addresses retaliation against people who invoke protected rights and separate religious nondiscrimination in visitation, subject to appropriate restrictions. It does not assert general OCR employment-discrimination jurisdiction: Title VI’s employment reach has a statutory primary-purpose limitation, while staff and trainees may be covered program participants. Suggested measures include accessible reporting, consistent response, restoration of access and follow-up; these are fact-specific compliance measures rather than a new uniform implementation deadline.
