California expands Covered California plan options and application intake

AB 1907 expands specified automatic Covered California enrollment options and complete-application intake beginning July 1, 2027. The final law also addresses coverage-effectuation notices and makes specified open-enrollment rules yield to conflicting federal requirements for 2027 policy years.

What happened

California enacted AB 1907 in September, with replacement Government Code section 100503.4 operative July 1, 2027. When it receives a qualifying electronic account or complete insurance-affordability application through the Statewide Automated Welfare System, Covered California must use available information to enroll people determined eligible for financial assistance in a specified plan. Options include the lowest-cost silver plan, the plan used by other members of the modified-adjusted-gross-income household, the lowest-cost plan for an eligible Indian receiving the cited reduced cost sharing, or a qualifying previous managed-care plan when the Exchange has the necessary information.

Enrollment timing must align with termination of prior affordability coverage or receipt of the complete application, and the premium cannot be due before the last day of the first month. A notice before coverage becomes effective must identify the selected plan, alternatives and deadlines, assistance, the right not to enroll, relevant appeal information and instructions for paying or opting into a no-premium plan. Separate plan and insurer amendments address policy years beginning January 1, 2027: the specified enrollment window and coverage-effective dates apply except to the extent inconsistent with the cited federal regulation, in which case its requirements control. Those provisions should not all be assigned the later July application-intake date.

Why it matters

A complete application, an electronic transfer and a household-plan choice are distinct enrollment inputs. Product, eligibility and member-service teams need the same timing and effectuation instructions, especially where the federal enrollment rule controls.
