Federal independent dispute resolution rule corrected, payment determination text restored and applied back to August 3

The federal IDR correction restores omitted text and repairs references across the joint out-of-network dispute rules. It became effective August 28 and applies from August 3, preserving the departments’ stated policies while clarifying binding determinations and the operative regulatory text.

What happened

Treasury, Labor, HHS and OPM published an August 28 correcting amendment to the June 4 Federal Independent Dispute Resolution Operations final rule, 91 FR 33900. It restores omitted provisions and corrects drafting instructions, placeholders and cross-references across 26 CFR part 54, 29 CFR part 2590 and 45 CFR part 149. The correction is effective August 28, 2026 and applies beginning August 3, the final rule’s effective date. For 45 CFR 149.510(c), the departments include the paragraph in full because the earlier text was incomplete.

The restored binding-determination language makes a certified IDR entity’s determination binding absent fraud or intentional misrepresentation of material claim facts and limits judicial review to the cited federal arbitration grounds. Other corrections remove an inadvertently retained word and repair references connecting payment determination and related procedures. The departments explain that these changes correct the text to reflect policies already described through notice and comment, rather than adopt new substantive policy, and invoke good cause to avoid another proposal and a delayed effective date. The earlier August applicability is therefore material when reviewing dispute procedures used after the original rule took effect.

Why it matters

Provider dispute templates or vendor workflows built from the June publication can cite incomplete or incorrect text. The stated policy continuity does not remove the need to compare the corrected regulation with submissions and escalation instructions already in use.
