CMS makes revised Critical Access Hospital emergency-services readiness guidance effective immediately
Oct 4, 2026 edition · GC-2026-0102 · Published 2026-10-04 · Version 2 · Final
CMS's September 18 Appendix W revision explains CAH emergency-readiness surveys, including evidence-based protocols, available provisions and actual implementation for obstetrical and other emergencies.
What happened
CMS Transmittal 247 revised State Operations Manual Appendix W with September 18, 2026 effective and implementation dates. The new C-0896 guidance addresses the critical access hospital emergency-readiness standard at 42 CFR 485.618(e), whose text identifies a July 1, 2025 effective date. The September event is therefore updated survey guidance, rather than the first effective date of the underlying standard. CMS calls for protocols consistent with nationally recognized evidence-based guidance for emergency conditions, including obstetrical emergencies, complications and immediate post-delivery care, in keeping with the hospital's scope and complexity of services.
The guidance links written protocols to adequate equipment, supplies, medications, blood products and personnel, as well as defined staff roles. It calls for medical staff and governing-body approval, accessible protocols and review against current standards. Surveyors are directed to examine three elements: required protocol content, actual implementation and adequate provisions. They may review emergency records, interview staff, inspect supplies and ask staff to explain equipment use and escalation or transfer when needs exceed the CAH's capabilities. CMS expressly tells surveyors to focus on documentation and protocol alignment rather than evaluate clinical judgment. A policy-only review would miss the operational evidence described in the revised procedures.

Why it matters
CAHs need evidence that emergency protocols are approved, accessible and used with functioning resources, including for unexpected obstetrical emergencies.
Recommended action
Compare protocols and resources with C-0896, confirm approval and staff access, and sample emergency-care evidence. Address gaps in supplies, equipment, roles and transfer pathways, preserving the distinction between the existing standard and revised survey guidance.
