California changes health coverage requirements for antiretroviral products

SB 1023 requires specified non-self-administered HIV-prevention products to be available under both medical and pharmacy benefits for contracts and policies issued, amended or renewed from January 1, 2027.

What happened

California chaptered SB 1023 on September 26, 2026, changing coverage for FDA-approved antiretroviral drugs, drug devices and drug products used to prevent HIV/AIDS. For affected health plan contracts and health insurance policies issued, amended or renewed on or after January 1, 2027, non-self-administered products must be covered under both medical and prescription drug benefits. A product obtained through the prescription drug benefit must be dispensed and administered by a provider acting within the scope of their license. The contract or policy trigger matters: the chaptered text supplies a future implementation date rather than an October 4 requirement to treat all existing coverage as already changed.

The amended sections also prohibit prior authorization and step therapy for medically necessary HIV-prevention products, including PrEP and PEP, while retaining a therapeutic-equivalent exception if at least one equivalent is available without those restrictions. They preserve coverage for pharmacist-furnished PrEP and PEP, pharmacist services and related testing, with out-of-network payment tied to an out-of-network pharmacy benefit. Specialized dental, mental health or vision coverage and Medicare supplements are excluded. The health plan section also excludes Medi-Cal managed care to the extent these services are outside its contract with the Department of Health Care Services. Benefits teams therefore need to assess the product, benefit channel and particular coverage arrangement rather than apply a single rule to every antiretroviral use or insurance product.

Why it matters

Plans, insurers, pharmacy benefit managers and dispensing partners need coordinated benefit and administration arrangements so eligible non-self-administered prevention products can be accessed through both channels.
