SB 1206 updates accident and health insurance licensing controls

SB 1206 extends inactive insurance-license consequences to additional Secretary of State entity statuses and adds accident and health or sickness agents to organizational personnel rules. The omnibus also specifies regulator-response and background-change controls with distinct insurance scopes.
What happened
California enacted SB 1206 on September 27. Amended Insurance Code section 805 makes a license inactive when the Secretary of State lists the licensee as dissolved, forfeited, terminated, canceled or surrendered, as well as suspended. The entity may not conduct activity requiring an Insurance Commissioner license until restored to active Secretary of State status. Section 1661 adds accident and health or sickness agent organizations to the requirement to file an immediate prescribed electronic application or notice when changing the natural persons transacting under the organization’s license. Under amended section 1712.5, removing or terminating the last named natural person makes that organizational license inoperative until deficiencies are corrected. The enactment is the event reported here; the applicable commencement of these provisions must be confirmed separately.
Related provisions require changes in contact or background information to be reported within their stated 30-day periods. Background information expressly includes restitution orders and fine or monetary-penalty orders, excluding late fees. Section 1736.5 requires a complete written response to a commissioner inquiry to be received no later than 21 days after the inquiry was communicated, covering licensing, retention, renewal and specified investigations; requested records must be included. The measure contains many other insurance subjects, including property and public-adjuster provisions, so the provisions relevant to a health insurance agency should be identified by license type rather than applied to all clinical operations.

Why it matters
Corporate standing and the presence of an endorsed natural person are separate conditions for an organizational insurance license. An agency can miss a licensing problem if it checks only renewal dates, and regulatory correspondence needs a reliable owner.
Recommended action
Confirm the applicable commencement before treating the new provisions as current duties. Prepare the following for implementation at that commencement: Check Secretary of State standing, organizational endorsements and coverage when a responsible person leaves. Review 30-day change reporting and the complete-response process for 21-day commissioner inquiries. Map each applicable omnibus section to the actual insurance license and business function.
