AB-2311 Health care districts: employment

AB 2311 creates a limited physician-employment exception for qualifying health care districts and sole-member nonprofit corporations. Eligibility turns on specified hospital distress or public-payer criteria, with medical-staff approval, professional-independence protections, and recruitment reporting; the employment authority lasts only until January 1, 2037.

What happened

Chaptered September 18 as Chapter 299, AB 2311 permits a qualifying health care district or nonprofit corporation with a health care district as its sole corporate member to employ licensees and charge for their professional services. The entity must own or control a general acute care hospital meeting the statutory conditions. The hospital must have received a Distressed Hospital Loan Program award before January 1, 2025, or meet the greater-than-75-percent combined Medicare and Medi-Cal payer-mix test using the specified January 1, 2025 data. Under the payer-mix route, both the hospital and any health system to which it belongs must exceed the threshold.

The medical staff must affirmatively approve the employment under its bylaws, and neither the district, nonprofit, nor controlled hospital may direct the physician's professional judgment. Employed positions must add to rather than supplant the identified existing medical-staff positions, subject to mutually agreed contract amendments, and prospective employees must be offered contracting instead. Beginning in 2028, an entity using the exception must publish the specified annual recruitment-and-retention report by July 1. The employment authority ends January 1, 2037; the amended section has a separate July 2037 transition, so those dates serve different purposes.
