California home health licensure moratorium continues; management filings due March 31
Oct 11, 2026 edition · GC-2026-0016 · Published 2026-10-11 · Version 3 · Effective
CDPH's existing home-health licensure restrictions remain an implementation issue in the October 11 edition. The October 9 response deadline for specified pending applications has passed, while currently licensed agencies have a March 31, 2027 management-personnel filing, with separate rules for ongoing changes and exceptions.
What happened
CDPH AFL 26-28 explains the SB 164 moratorium on initial home-health agency licenses and branch approvals beginning June 29, 2026, with its stated regulatory endpoint and unmet-need exception process. For applications pending on June 29, the letter required an intent to withdraw or the specified justification and documentation by October 9; it states that nonresponse results in automatic withdrawal. As of the October 11 edition, that response date has passed. The retained letter does not establish the disposition of any particular applicant's case.
Currently licensed agencies must submit information for their administrator, administrator designee, director of patient care services, and DPCS designee by March 31, 2027. The package includes the identified form, résumé, and list of facilities and agencies each person serves; changes require submission within ten business days, and a branch of a parent HHA is exempt from these management-information requirements. The separate five-year ownership-change restriction has continuity-of-care or financial-hardship-and-unmet-need exception routes. The moratorium also distinguishes service-area and branch changes from ordinary renewals and the identified other report-of-change applications.

Why it matters
Nonresponse by October 9 triggers application withdrawal under the letter. Existing agencies must submit administrator, administrator designee, DPCS and DPCS-designee information by March 31; changes must be reported within 10 business days. The moratorium and five-year CHOW restriction have stated exception routes.
Recommended action
Confirm the disposition of any application subject to the elapsed October 9 deadline with CAB, without assuming an extension or a particular agency outcome. Assign the March 31 management filing and timely change reporting. Assess new-license, branch and CHOW restrictions before transactions; retain applicable exclusion screening and ownership disclosures.
