SB 1302 changes nursing medication-order authority, education and credentialing requirements

SB 1302 revises California nursing authority, education, and credentialing provisions. The September 20 law recognizes specified nurse-practitioner and nurse-midwife medication orders and APRN directions within scope, while setting separate milestones for out-of-state transition experience and continuing-education documentation at renewal.

What happened

California chaptered SB 1302 on September 20 as Chapter 429. Its amended nursing definition includes medication and therapeutic-agent administration under orders of nurse practitioners and certified nurse-midwives practicing under the cited statutory authorities, as well as directions of an APRN within that practitioner's authorized scope. The law also revises nursing-education controls, including simulation standards and conditional requests for reduced direct-care clinical hours when the specified emergency and placement conditions are met. Those requests retain evidence, educational-equivalence, duration, and approval safeguards, rather than providing a general waiver of clinical preparation.

For qualifying out-of-state nurse-practitioner transition-to-practice experience, BRN must identify states whose practice experience meets or exceeds the California requirements by January 1, 2028, maintain a website list, and review changes in those states. A separate January 1, 2029 provision requires continuing-education proof at license renewal, including completion documentation for the preceding renewal period or two years. These milestones address different Board and licensee functions; neither makes every nurse practitioner or APRN an unrestricted prescriber or removes the underlying qualification and practice-setting requirements.
