SB 1209 requires correction of insurer examination violations
Oct 11, 2026 edition · GC-2026-0239 · Published 2026-10-11 · Version 3 · Final
SB 1209 adds an enforceable corrective-action framework for violations found in insurer examinations and operational reports. The agreed remediation timetable, good-cause extension process, category-based penalties, and notice and hearing protections are distinct from the existing report-rebuttal periods.
What happened
California enacted SB 1209 on September 30 as Chapter 1017. Insurance Code section 734.1(c) requires an examined company to correct identified violations of applicable statutes, regulations, referenced statutory accounting principles, and other legally binding rules. Failure to adopt necessary correction within the timeframe agreed with the Commissioner or designee can incur up to $20,000 per failure, determined by the specific corrective-action category. The existing report transmission, rebuttal, and adoption periods remain part of examination review; they do not establish a single 30-day correction deadline for every finding.
Companies may request additional 30-calendar-day or greater approved good-cause extensions, but requests can be denied for bad faith or lack of a good-faith compliance effort. Enforcement uses an order to show cause stating charges and potential liability, a hearing at least 30 days after service, and an order if the charges are justified, with administrative and judicial review protections retained. For the specified agents and brokers, proportionality and operational scale and complexity enter penalty assessment. These provisions create a structured remediation and adjudication pathway rather than making each report recommendation an immediately assessed fine.
