DHS finalizes removal of most automatic EAD renewal extensions

The October 14 final rule adopts the 2025 interim rule without change. The filing cutoff remains October 30, 2025; eligible earlier renewals and extensions provided by law or notice retain their separate treatment.

What happened

DHS published a final rule effective October 14 adopting without change the 2025 interim rule that removed most automatic employment-authorization-document extensions for renewal applications filed on or after October 30, 2025. Finalization does not create a new October 2026 filing cutoff. Employers therefore need the renewal filing date, category and applicable authority to determine which extension framework applies, rather than treating all pending renewals alike.

Eligible renewals filed before the October 30, 2025 cutoff can retain the earlier automatic extension, potentially up to 540 days from the card’s expiration date while the application is pending, subject to the applicable receipt and category conditions. Extensions provided by law or a Federal Register notice, including applicable Temporary Protected Status extensions, remain distinct. An EAD extension does not extend advance parole printed on a combination card, and expiration of an EAD does not establish loss of underlying work authorization for every status. USCIS’s M-274 summary provides background; category-specific instructions require their own review.

Why it matters

Workforce continuity depends on applying the correct filing-date and category rules. A blanket assumption that every renewal receives 540 days, or that every expired card ends authorization, can produce incorrect employment decisions.

Implementation playbook

  1. Recommended internal target: Have the employment-eligibility team review pending-renewal workflows against the final rule and the actual category-specific USCIS instructions. Record the authority used for each conclusion and obtain counsel review of unresolved cases. Playbook dates are internal targets. Compliance · Due 2026-10-23
  2. Recommended internal target: document the scoped assessment, accountable functions and any required follow-through; escalate unresolved legal questions. Legal · Due 2026-10-30
