What happened

DMHC executed a combined letter of agreement with Medi-Excel, S.A. de C.V., on September 27, 2026, covering matters 20-450 and 24-456. The agreement carries one $50,000 administrative penalty and a corrective action plan. Its two document listings reproduce the combined agreement; they do not establish two separate $50,000 penalties. Follow-up reports found two deficiencies uncorrected after the 2018 survey and three after the 2021 survey. The plan acknowledged noncompliance, while the agreement limits use as an admission in civil or criminal proceedings and allows DMHC to consider the violations in future proceedings involving the plan.

The findings include inadequate assistance for enrollees with visual or other communicative impairments, UM monitoring described in policies without sufficient implementation evidence, and required grievance-language defects in sampled letters. Of eight emergency-denial files reviewed, five were excluded as misclassified and two of the remaining three used an incorrect payment standard. The corrective plan required a certified statement addressing all deficiencies, a grievance-acknowledgment template and an emergency-services payment policy by September 30. As of October 4 that deadline had passed; the agreement alone does not prove delivery or DMHC acceptance of those materials.

Why it matters

Survey closure requires evidence that controls operated, including accessible grievances, accurate notices and the correct emergency-payment standard. A revised policy alone did not satisfy the cited monitoring concern.
