What happened

On September 30, DOJ announced that Signal Diagnostics agreed to pay $20.5 million to resolve False Claims Act allegations involving the federal COVID-19 Uninsured Program. The program reimbursed eligible providers for specified testing, treatment and vaccination services for uninsured individuals. Signal provided COVID-19 tests at public and client testing sites and submitted the disputed testing and specimen-collection claims between October 2020 and March 2022. The settlement addresses alleged avoidance of repayment obligations from January 2022 through May 2023, rather than a new coverage rule or a finding that all of Signal’s testing was improper.

DOJ says an internal audit beginning around January 2022 found claims for patients who had insurance. Alleged causes included multiple profiles for the same person with conflicting coverage information and claims submitted despite alternative insurance being listed in the system. Signal allegedly continued the audit, calculated overpayments and knowingly avoided refunding the ineligible amounts. That sequence distinguishes initial eligibility errors from what happens after a provider identifies an overpayment. The $20.5 million resolution settles those allegations; the release expressly states that there has been no determination of liability.
