Axim founder James Vincent Campbell pleaded guilty to theft from an ERISA plan involving more than $8.8 million. DOJ describes unauthorized withdrawals and undisclosed excess fees on funds intended for health premiums and retirement accounts. Sentencing was pending, so the five-year maximum is not an imposed sentence.
What happened
James Vincent Campbell, founder and CEO of Axim Fringe Solutions Group LLC, pleaded guilty September 29 in Maryland to theft from an ERISA benefit plan. Axim processed employee benefits for federal contractors, receiving money intended for health-insurance premiums and retirement contributions and forwarding it to carriers and retirement accounts. DOJ describes more than $8.8 million unlawfully converted from clients through withdrawals from a pooled master trust and repeated excess charges. The case therefore concerns money entrusted to an intermediary, rather than claims for medical services.
The account of court documents identifies 135 unauthorized withdrawals totaling $2,486,905 during 2015–2024, followed by secretly charging some clients up to five times their agreed fees after the business moved to Arizona. The withdrawal figure is part of the overall loss, not a separate additional $8.8 million. Sentencing remained for the judge to determine, with a statutory maximum of five years. For employers and plan fiduciaries, the control issue is whether contributions actually reach their intended recipients and whether deducted fees match the agreement; an intermediary’s statement alone does not reconcile the carrier or trust receipt.
