Houston physician indictment alleges impossible COVID-19 office visit volume

A twelve-count indictment alleges impossible office-visit volumes at COVID testing sites operating under Joseph Montes’ name. The government alleges approximately $30 million billed and $20 million paid. The indictment was returned September 30 and unsealed October 6; the charges remain unproven.

What happened

DOJ’s October 6 announcement reports that Dr. Joseph A. Montes was taken into custody and appeared in federal court after unsealing of a twelve-count indictment returned September 30. The indictment alleges false claims to HRSA for office visits not performed during 2020–2022. Montes owned Joseph A. Montes MD & Associates, P.A. and Montes Medical PLLC and allegedly allowed others to operate pop-up COVID testing sites under his name, where patients received nasal swabs while office visits were billed.

The alleged volumes included more than three thousand evaluation-and-management claims on approximately twenty-nine dates and more than nine thousand on December 1, 2021, described as about one visit every nine seconds around the clock. The government alleges approximately $30 million in billing and $20 million paid, distinct figures rather than an imposed penalty. The indictment is an accusation, and Montes is presumed innocent. The specific control question is whether clinician presence, encounter duration and documented E/M work can support the claimed volume; a testing site’s operation under a physician’s name does not alone demonstrate those visits occurred.

Operational lessons

  • Authorities allege approximately $30 million billed and $20 million paid, including over 9,000 visits on one day. The indictment is not evidence of guilt.
  • Compare encounter capacity, provider presence and documented E/M work with billed volume; independently validate operations under a physician's name.
