Tiero founder indicted over false laboratory claims for home COVID tests
Oct 11, 2026 edition · GC-2026-0283 · Published 2026-10-11 · Version 4 · Pending litigation
The Tiero founder’s indictment alleges laboratory-style billing for shipped, self-administered COVID tests using false CLIA and claim information. DOJ alleges more than $100 million claimed and $50 million paid. The pending charges concern representations about actual services, rather than a general ban on home testing.
What happened
An October 9 federal indictment charges Marc Aaron Potash, founder and CEO of Tiero LLC, with healthcare-fraud conspiracy, seven substantive fraud counts and five transactions involving criminally derived proceeds. DOJ alleges that the January 2022–May 2026 scheme submitted false claims to Medicare, Medicaid, the Federal Employees Health Benefits Program and other insurers. The alleged conduct includes false documents submitted to Maryland authorities to obtain CLIA certification and representations that clinicians performed testing at the company’s laboratory.
According to the indictment, Tiero instead shipped over-the-counter, self-administered COVID tests while claims listed false dates, places of service and rendering providers. DOJ alleges more than $100 million in false claims and more than $50 million in payments, neither of which is a fine or completed recovery. The defendant is presumed innocent, and the release’s possible prison terms depend on conviction. The case-specific issue is the mismatch between shipped products and the laboratory services represented to regulators and payers. Verification should connect certification representations with the actual test, location and provider reported on each claim.
