AB 1682 adds prescribed FDA-cleared scalp cooling coverage for qualifying large-group 2027 contracts and conditionally for Medi-Cal.
What happened
California approved and filed AB 1682 on September 27. The enacted commercial provisions apply to large-group plan contracts and insurance policies issued, amended or renewed on or after January 1, 2027. They require coverage for scalp cooling prescribed by a health care provider to reduce the incidence or severity of hair loss before, during or after treatment with alopecia-inducing chemotherapy. Copayments, coinsurance and deductibles remain permissible, but may be no less favorable than those for oncology supportive care under the same coverage. Specialized plans and policies are excluded from these commercial provisions.
The covered scalp-cooling definition requires an FDA-cleared device or system and expressly excludes non-cleared cold caps or products regardless of their marketing label. Medi-Cal managed care contracts fall under the separate WIC 14132.65 provision instead of the large-group mandate. That provision treats prescribed scalp cooling as a covered benefit subject to medical necessity and utilization controls, but implementation is conditioned on necessary federal approvals and available federal financial participation that is not jeopardized. DHCS may implement through letters, bulletins or similar instructions. As of October 4, the chaptered language supports preparation and monitoring of those conditions, rather than assuming every chemotherapy patient or product is already payable.

Why it matters
Oncology benefit and authorization rules need to identify eligible devices, contracts and cost sharing while distinguishing the conditional Medi-Cal pathway.
Recommended action
Identify qualifying large-group renewals, FDA-cleared devices and oncology supportive-care cost sharing. Track Medi-Cal federal approvals and DHCS implementation instructions before activating that pathway.
