SB 964 creates a qualifying drug dose adjustment request pathway

SB 964 creates a conditional 72-hour written-response pathway for dose or frequency adjustments to previously approved serious-condition treatment.

What happened

California approved and filed SB 964 on September 27. The enacted text allows a treating contracting provider to request written authority to adjust a drug’s dose or frequency without prior authorization or subsequent utilization management. The carrier must respond in writing within 72 hours of receiving the request and authorize it when the request establishes every required condition. The drug must previously have been approved for that member’s serious chronic condition or cancer treatment, with the treating provider continuing to prescribe it for that condition. Opioids and scheduled controlled substances are excluded, and the dose must not have been adjusted more than twice without prior authorization.

The pathway also does not apply to an off-label use or adjustment unless it meets the additional conditions in the referenced off-label coverage provision. Medi-Cal managed care plans are excluded from the plan section. A qualifying written request and response therefore remain necessary; the law does not authorize unrestricted unilateral adjustments to every approved prescription or repeal all subsequent review. As of October 4, teams should prepare the evidence and response workflow while confirming applicable commencement before activating the new process.
